In this child protection action brought pursuant to the Child and Family Services and Child Protection Act, 22 M.R.S.A. §§ 4001-5005 (Supp.1988), the District Court (Wiscasset, O'Rourke, J.) found by a preponderance of the evidence that Erika R. was in circumstances of jeopardy to her health or welfare because of sexual abuse by her father and granted custody of Erika to the Department of Human Services (DHS). 22 M.R.S.A....
