After having been removed to the United States District Court, the main demand in this appeal has now been remanded to us for consideration.

Defendant, Robert LaCombe, appeals the district court judgment awarding damages for the wrongful death of Larry Malmay, Marsha Jan Malmay's husband and the father of their three children.
