On April 3, 1986, the appellant, Timothy Levy, was traveling from Jamaica to St. Martin in the Caribbean, when his plane made a scheduled stop in Puerto Rico (to pick up, but not to discharge, passengers). United States Customs agents, looking through the plane's luggage compartment, found a metal box containing marijuana in a suitcase.
