OPINION

FAY, Chief Justice.

These consolidated cases come before us on the state's petition and the defendant's cross-petition for certiorari. The state seeks reversal of a Superior Court order granting the defendant's motion for a new trial pursuant to Rule 33 of the Superior Court Rules of Criminal Procedure. The defendant's cross-petition requests a judgment of acquittal or an affirmance of the new-trial order. We affirm the trial justice's decision....
