This cause comes before the Court on the Defendants' Motion to Dismiss or, in the Alternative, for Summary Judgment and Plaintiff's Motion for Leave to Amend Complaint. Defendants argue that the Amended Complaint fails to state a claim upon which relief can be granted. For the reasons enumerated below, the Court holds that the Defendants' Motion to Dismiss should be granted and the Plaintiff's Motion...
