This matter is before the Court on crossmotions for summary judgment and for attorney's fees. For the reasons set forth below, the Court (1) grants the defendant's summary judgment motion in part and denies it in part; (2) denies the plaintiff's summary judgment motion in toto; and (3) denies both parties' motions for attorney's fees.
