MEMORANDUM OPINION
JARVIS, District Judge.
This is an action brought pursuant to § 301 of the Labor Management Relations Act, 29 U.S.C. § 185, alleging that plaintiff was terminated by his employer Ryder/PIE. Nationwide, Inc. ("Ryder") wrongfully for allegedly failing to report an accident. He also claims that his union, Teamsters Local 519 ("union"), breached its duty to fairly represent him in pursuit of his grievance.
