No. 88-1012.

544 So.2d 269 (1989)

Roy F. COLVIN, Appellant, v. Roy F. COLVIN and State Farm Insurance Company, Appellees.

District Court of Appeal of Florida, First District.

Rehearing Denied June 27, 1989.

Attorney(s) appearing for the Case

Herbert M. Hill, of Hurt & Parrish, P.A., Orlando and Bill McCabe, of Shepherd, McCabe & Cooley, Longwood, for appellant.

Lamar D. Oxford, of Dean, Ringers, Morgan & Lawton, Orlando, for appellees.

PER CURIAM.

The claimant in this Workers' Compensation case appeals an order denying a claim for temporary partial wage loss benefits or wage loss benefits. The claim was denied on the ground that the claim was not timely under section 440.15(3)(b). We reverse and remand for a determination on claimant's entitlement to any wage loss without deciding the merits of the deputy commissioner's application of this statute.
