LARSON, Justice.

David Simmons was found guilty of violating a Panora, Iowa, curfew ordinance which restricted the rights of children under eighteen to be in public places between ten o'clock p.m. and five o'clock a.m. The penalty imposed was small—a $1 fine plus surcharge and costs—but potential constitutional issues prompted us to grant discretionary review.
