The defendant, Donald Scherzer, was charged by indictment in Du Page County with attempted murder, conspiracy to commit murder, armed violence (based on aggravated battery), aggravated battery, and armed robbery. (Ill. Rev. Stat. 1985, ch. 38, pars. 8-4(a), 8-2(a), 33A-2, 12-4(a), 18-2(a).) The conspiracy charge was nol-prossed, and a jury found the defendant guilty of the remaining...
