This appeal is from the trial court's denial of appellant's motion for discharge and acquittal, brought pursuant to OCGA § 17-7-170 (b).

On April 20, 1988, accusations were filed by the Solicitor of Glynn County in the state court charging appellant with simple battery and public drunkenness.
