Ordered that the order is modified, by deleting the provision thereof denying that branch of the defendant and third-party plaintiff's motion which was for a protective order with regard to item number 16 of the notice for discovery and inspection and substituting therefor a provision granting that branch of the motion; as so modified, the order is affirmed insofar as appealed from, without costs or disbursements, and the appellant's time to comply with the notice of discovery...
