ARMSTRONG, Judge.

Defendant, Robert Harrison, was indicted by a grand jury for second-degree murder, a violation of La.R.S. 14:30.1. After two mistrials, one resulting from a hung jury, defendant was found guilty of manslaughter, a violation of La.R.S. 14:31. He was adjudged a habitual offender (third offense) and sentenced to forty-two years at hard labor without benefit of probation, parole, or suspension of sentence....
