Defendants Police Department of the City of New York ("NYCPD") and the City of New York (the "City") have moved pursuant to Rule 12(b)(6) Fed.R.Civ.P. to dismiss the complaint of plaintiff Lionel Tuckett ("Tuckett") on the ground that all claims in the complaint are time barred, and pursuant to Rule 12(b)(1) to dismiss the claims brought under Title VII of the Civil Rights Act of 1964, as amended, for lack of subject matter...
