Ordered that the judgment is affirmed.

The defendant was convicted in 1982 of robbery in the first degree and robbery in the second degree, and he was sentenced as a second felony offender to indeterminate concurrent terms of imprisonment of 5 to 10 years and 4 to 8 years, respectively. However, this court reversed the judgment on the basis of errors in the court's charge and ordered a new trial (People v Van Pelt, 119 A.D.2d 707
