(1) (See fn. 1.) Kenneth Ten Eyck (plaintiff) appeals from an order of the Los Angeles Superior Court which granted a motion for summary judgment in favor of defendant Industrial Forklifts Co. (Industrial).1 For the reasons discussed below, his appeal is untimely and must be dismissed.
