Plaintiff Jeanne Farley was denied a permit to build a house on a 3.7-acre lot in Lyman that her parents gave her shortly before the Town raised the applicable minimum lot size to 5 acres. The Lyman Zoning Board of Appeals denied her appeal on the ground that her lot lost its status as a nonconforming lot of record when she conveyed the land to her sister, the owner of an abutting lot; the Board reasoned that upon coming into single ownership...
