LOZANO v. STATE

No. 87-1403.

540 So.2d 131 (1989)

Manuel Enrique LOZANO, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, Second District.

Rehearing Denied March 30, 1989.

Attorney(s) appearing for the Case

James Marion Moorman, Public Defender, and W.H. Pasch, Asst. Public Defender, Bartow, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Davis G. Anderson, Jr., Asst. Atty. Gen., Tampa, for appellee.

SCHEB, Judge.

The defendant, Manuel Enrique Lozano, appeals his convictions and sentences for several drug offenses. He raises two points. First, he contends that his convictions and sentences for trafficking under count I and possession under count III violate the constitutional guarantee against double jeopardy. The defendant is correct. Since these convictions and sentences arose from the same act involving the same cocaine, one conviction must be reversed.
