19 Conn. App. 646 (1989)

STATE OF CONNECTICUT v. RALPH SMITH

Appellate Court of Connecticut.

Decision Released September 12, 1989.

Attorney(s) appearing for the Case

Louis S. Avitabile, with whom, on the brief, was Denise Dishongh, for the appellant (defendant).

Leon F. Dalbec, Jr., deputy assistant state's attorney, with whom, on the brief, was James Turcotte, deputy assistant state's attorney, for the appellee (state).

BORDEN, SPALLONE and DALY, JS.

BORDEN, J.

The defendant appeals from the trial court's denial of his motion to open a judgment of conviction and to set aside his guilty pleas, filed nearly one year after he had pleaded guilty and nearly eleven months after he had been sentenced. The defendant claims that the court erred in ruling that it had no authority to grant his motion and in refusing to hold an evidentiary hearing on the factual claims raised by his motion. We find no error.
