Advertising Company, hereinafter called "condemnee," filed a petition for appointment of a jury of view under and pursuant to section 502 of the Eminent Domain Code, the Act of December 5, 1969, P.L. 316 §1, 26 P.S. 1-502, alleging a de facto taking. The Pennsylvania Turnpike Commission, hereinafter called "condemnor," filed preliminary objections to that petition. We will dismiss those preliminary objections.
