FOLEY, Judge.

This wrongful death action was brought by respondent Sharon Kay Hart, as Trustee for the heirs of James J. Hart, deceased, against appellant FMC Corporation and several other defendants. The other defendants settled, and the case proceeded to trial against FMC. The jury found FMC was 20% at fault and assessed damages in the amount of $1 million.
