On Friday night, December 20, 1985, David Berkel, the chief of police of Lenox, entered a crawl space under the defendant's first-floor apartment on Housatonic Street with the permission of the owner of the property. The crawl space is used for access to pipes and wiring. Tenants and the public have no access to it.
