This case arises out of a decision by appellee, the Department of Health and Mental Hygiene (Department), regarding the regulatory scope of a private landfill permit issued jointly to Patapsco Valley Farms, Inc. (Patapsco) and Chesapeake Clearing (Chesapeake). The Department concluded that the landfill permit governed the entire 222-acre farm owned by James F. Jett and that landfill was restricted to a designated 4.53-acre area within the 222...
