Appellant, John Raymond Stabler, was convicted upon a jury verdict of first-degree murder, armed robbery and theft of property valued over $1,000. As part of a plea agreement wherein the state agreed not to seek the death penalty, appellant pled guilty to attempted first-degree murder, armed robbery, kidnapping and theft of property valued over $1,000.
