The defendant has appealed from his convictions of assault with intent to kill, assault and battery by means of a dangerous weapon, and unlawful possession of a firearm. We transferred the case to this court on our own motion. The defendant was indicted on a charge of assault with intent to murder (G.L.c. 265, § 18), but convicted of the lesser-included offense of assault with intent to kill (G.L.c. 265, § 29).
