This matter is before the Court on Crossmotions for Summary Judgment. The Court has reviewed the pleadings and the memoranda of the parties and, pursuant to Bankruptcy Rule 7056 and F.R.C.P. 56, finds that there are no disputed facts at issue thus rendering this matter ripe for summary judgment.
