Mark Gennardo, petitioner-appellant, filed a post-conviction petition to vacate his conviction and six years' imprisonment sentence for an unlawful delivery of cocaine and for a new trial. The petition alleged that the State failed to comply with the mandate of Brady v. Maryland (1963), 373 U.S. 83
