In the circuit court of Cook County, defendant, Farley Shumpert, was indicted for "murder" under the Criminal Code of 1961 (Ill. Rev. Stat. 1985, ch. 38, pars. 9-1(a)(1), (a)(2) (the old homicide statute)). The murder allegedly took place on May 1, 1987. Defendant filed a motion to dismiss the indictment alleging that Public Act 84-1450...
