On January 7, 1981, plaintiff Charles Yaeger, who had been employed by a subcontractor, third-party defendant Dover Elevator Company, of general contractor John Thatcher & Son, was working at a construction site at 1166 Sixth Avenue in Manhattan when he was injured in the course of erecting a truck elevator.
