The State of Wisconsin Elections Board (Board) appeals from an order of dismissal entered in favor of Edward E. Hales (Hales). We conclude that the Board properly initiated its suit against Hales, alleging that he violated sec. 11.36(1), Stats. Therefore, we reverse.

The facts are undisputed and straightforward. On February 25, 1986, the Board received a complaint alleging that Hales, who was serving as chairman of the Wisconsin Investment Board...
