SONENSHINE, J.

Jack J. Miller appeals the dismissal of his insurance bad faith action pursuant to Code of Civil Procedure section 583.410. We do not reach the propriety of the dismissal. Instead, we apply Code of Civil Procedure section 660 and California Rules of Court, rules 2 and 3(a), and find the appeal is untimely.1
