No. 1052 C.D. 1988.

123 Pa.Commw. 299 (1989)

554 A.2d 159

George M. Lynch, Petitioner v. Workmen's Compensation Appeal Board (Connellsville Area School District), Respondents.

Commonwealth Court of Pennsylvania.

February 2, 1989.

Attorney(s) appearing for the Case

George M. Lynch, for petitioner, for himself.

H. Reginald Belden, Jr., Stewart, Belden and Belden, for respondent, Connellsville Area School District.

Argued October 3, 1988, before Judges BARRY and PALLADINO, and Senior Judge NARICK, sitting as a panel of three.

OPINION BY SENIOR JUDGE NARICK, February 2, 1989:

The sole issue on this appeal is whether the Workmen's Compensation Appeal Board (Board) erred in deciding that George Lynch (Claimant) was an independent contractor rather than an employee of the Connellsville Area School District (District) for the purpose of workmen's compensation under The Pennsylvania Workmen's Compensation Act.1
