This is a negligence action brought in 1983 by Alfred Trumpold, claiming damages for injuries he sustained in an automobile accident, and by his wife, Linda, for loss of consortium.1 The complaint alleged that an automobile, owned by the defendant Douglas Battery Corporation and driven by the named defendant, collided with the rear of the plaintiffs' vehicle while it was stopped at a traffic light.
