The defendant appeals from the judgment of conviction, after a jury trial, of the sale of heroin by a person who is not drug-dependent in violation of General Statutes § 21a-278 (b). The information alleged that the defendant was not a drug-dependent person at the time of the sale. The defendant claims that the trial court erred in permitting the state, after the defendant had rested and immediately prior to closing arguments, to file an amended information...
