Appellant/debtor-in-possession, Sierra Steel, Inc. ("debtor-in-possession") filed an adversary proceeding against appellee S & S Steel Fabrication ("appellee") seeking to avoid allegedly preferential transfers. The bankruptcy court granted appellee's Motion for Summary Judgment because it concluded that Sierra Steel, Inc. ("debtor") did not have any property interest in the sums transferred.
