Defendant was charged with driving under the influence following an accident on November 13, 1988. The complaint was filed by Officer J.G. Wolfgang of the Lock Haven City Police Department. Defendant was charged under both section 3731(a)(1) and (a)(4), i.e., he was incapable of safe driving and his blood-alcohol level was 0.25 percent.

Defendant has filed an omnibus pretrial motion in which he has raised several issues....
