On June 13, 1985, Bernard Siskind was involved in a motor vehicle accident, as a result of which he commenced an action against Edward Norris and Feinstein Iron Works, Inc., alleging personal injuries, including a herniated disc, and seeking $2,000,000 in damages. Siskind's wife, Pearl, was not named as a party in that action and no claim was made in her behalf.
