The plaintiff appeals from the granting of the defendant's motion for summary judgment. The plaintiff claims that the court erred (1) in denying the plaintiff's motion to strike or stay the motion for summary judgment, and (2) in finding that no genuine issues of fact existed to preclude the granting of the motion for summary judgment.
