The decisive issue in this appeal involves the scope of the constitutional duty of the state to preserve evidentiary material that, had it been subjected to certain tests, might have exonerated the defendant. The state appeals from the dismissal of the information charging the defendant with manslaughter in the second degree with a motor vehicle, in violation of General Statutes § 53a-56b.
