This matter is before the Court upon plaintiff Franklin Moore's Motion for Summary Judgment. Plaintiff Moore is the representative for a class of individuals similarly situated which appeared as a class of plaintiffs in a prior action tried before Judge Rubin of the District Court of the Southern District of Ohio, Western Division.
