WINSOR, J.

Rolando Visitacion appeals judgment and sentence for first degree assault. His personal restraint petition (PRP) has been consolidated with the appeal. Visitacion contends that his statement was taken and admitted in violation of his Sixth Amendment right to counsel, and that he received ineffective assistance of counsel. We remand the PRP for a determination on the merits.
