Discretionary review was granted to review an order denying a motion by defendants Shearson American Express and the Bradleys to compel arbitration of the claims alleged against them by Stephen and Dawn Kinsey. The motion was denied on the basis Shearson and its employee, Mr. Bradley (hereinafter Shearson), had waived its right to arbitrate the claims.
