ORDER

This case grew out of a high speed car chase involving Brower, an auto theft suspect, and pursuing police. The chase ended when Brower ran into a roadblock which had been constructed by police and sustained fatal injuries. The roadblock consisted of an 18-wheel truck parked across both lanes of the two-lane highway on which Brower was traveling, and a police car positioned between the truck and Brower's oncoming vehicle with its headlights on and pointed in...
