GRAHAM, District Judge.

This case arises out of a shooting incident which occurred in a bar in Columbus, Ohio. Raymond Belcher, an off-duty Columbus policeman, became involved in an altercation with three young men. Using his service revolver which he was carrying pursuant to departmental regulations, even though off duty, the officer shot the three young men, killing two of them and seriously injuring the third.
