Defendant-appellant, Timothy Glen Osterbrock (Osterbrock), has appealed from his conviction, by jury, on one count of conspiracy to possess with intent to distribute cocaine in violation of 21 U.S.C. § 846; two counts of distribution of cocaine in violation of 21 U.S.C. § 841(a)(1); and one count of using a telephone to facilitate the distribution of cocaine in violation of 21 U.S.C. § 843(b).
