Plaintiff Thomas Eberhard appeals as of right from an August 31, 1987, order granting summary disposition in favor of the defendant on plaintiff's negligence claim based on the equitable doctrine of laches. Following oral arguments in this appeal, we remanded the case to the trial court for a hearing and decision on the statute of limitations issue pled by defendant as an alternative affirmative defense.
