This matter comes before the Court upon the complaint of the Trustee, Harry Shaia, Jr., seeking avoidance of an allegedly preferential transfer made by the defendants. Finding that the recordation of a deed of trust within 90 days prior to bankruptcy constitutes a preferential transfer of an interest in the debtor's property under 11 U.S.C. § 547, the Court will order the deed of trust be avoided...
