This is an appeal from a judgment of the Franklin County Court of Common Pleas overruling plaintiff's motion for attorney fees. Third-party defendant, Ralph E. Hazelbaker ("Hazelbaker"), alleged that defendant's third-party complaint against him was frivolous conduc tin violation of Ohio's newly enacted R.C. 2323.51.
