The plaintiff, Michael Earl Dyer, appeals from the district court's decision that his claims are barred by the principles of res judicata and collateral estoppel. The district court so ruled because a lower Tennessee state court had previously dismissed an essentially identical case filed by Dyer for failure to state a claim upon which relief can be granted.
