In a two-count indictment returned on January 11, 1989, defendant Scott Bews was charged in Count I with knowingly, intentionally, and unlawfully possessing with intent to distribute cocaine in violation of 21 U.S.C. § 841(a)(1), and defendants Bews and Brian Clark were charged in Count II with conspiring to possess with intent to distribute cocaine in violation of 21 U.S.C. §§ 841(a)(1) and 846 and 18 U.S. C. § 2.
